Scalia: 2nd Amendment Doesn't Protect Cannons
The right to bear arms has it's limits says Justice Antonin Scalia, who says owning cannons might be found unconstitutional because you can't carry them, while surface to air missles might be fine because they can be borne.
They had some limitations on the nature of arms that could be borne, so, we'll see what those limitations are as applied to modern weapons.
Scalia practices textualism, which means he interprets the Constitution by looking at the text of a statute and comparing that to the original intent of the constitution - ie, what it meant to voters at the time it was written.
Textualism means that you're governed by the text... not whether the outcome is desireable, not whether legislative history says this or that, but the text of the statute....
